Roosevelt Lake Homes — Listing Agreement
This Listing Agreement ("Agreement") is between Whip Ventures LLC, doing business as Roosevelt Lake Homes ("RLH"), and the property owner ("Seller"). By completing payment through the Roosevelt Lake Homes checkout process, Seller confirms they have read, understood, and agree to the following terms.
1. Subscription Plans and Pricing
Roosevelt Lake Homes offers listing subscriptions with payment options as described on the pricing page at rooseveltlakehomes.com/pricing. The Seller's selected plan and payment option are confirmed at the time of payment through the Stripe checkout process. Subscriptions auto-renew at the end of each billing period unless canceled by the Seller.
2. Services Provided
RLH will provide listing and marketing services to all subscribers as described on the pricing page. Services generally include a dedicated listing page on rooseveltlakehomes.com, property detail display, photo hosting, buyer inquiry forwarding, and inclusion in site-wide marketing efforts. RLH may modify, add, or remove specific features over time. Material changes to the services included in an active subscription will be communicated to Seller with reasonable notice.
3. Optional Add-On Services
Sellers may purchase optional add-on services at any time, independent of their subscription. Available add-on services and current pricing are displayed on the pricing page. Add-on offerings and pricing are subject to change. Purchase of an add-on constitutes agreement to the pricing displayed at the time of purchase.
4. Subscription Fees and Payment
Seller agrees to pay the recurring subscription fee corresponding to their selected plan. Payment is processed through Stripe. Subscriptions auto-renew at the end of each billing period unless canceled by the Seller through the Stripe Customer Billing Portal or by contacting RLH.
5. Cancellation and Refunds
Subscriptions may be canceled at any time. The listing remains active through the end of the current billing period. No partial-period refunds are issued.
Add-on services are non-refundable once the service has been scheduled or performed. If a service has not yet been scheduled, Seller may request a refund within 7 days of payment by contacting RLH.
Upon cancellation, RLH will remove the listing from the Site at the end of the paid period.
6. Listing Publication
RLH will publish the listing as quickly as possible after receiving both payment and a completed property intake form. RLH reserves the right to edit listing content for clarity, formatting, and consistency with the Site's style.
7. Listing Maintenance and Active Seller Requirements
Listings remain active as long as the Seller's subscription is current and the Seller remains responsive. To maintain a trustworthy marketplace for buyers, the following requirements apply:
Responsiveness: Seller is expected to respond to buyer inquiries forwarded by RLH within 7 days. If Seller is unresponsive to two or more separate buyer inquiries, RLH may pause the listing and notify the Seller.
Stale or inactive listings: If the property is no longer for sale, the Seller becomes unreachable, or circumstances change such that the listing is no longer accurate, RLH reserves the right to pause or remove the listing.
Policy violations: RLH reserves the right to pause or remove any listing, and to terminate this Agreement, if Seller violates these terms, the Site's Terms and Conditions, or engages in conduct that is fraudulent, misleading, abusive, or otherwise harmful to buyers, other users, or the reputation of Roosevelt Lake Homes.
Paused listings: A paused listing can be reactivated at any time by contacting RLH and confirming the property is still available and the issue that caused the pause has been resolved.
8. Communication Consent
By entering into this Agreement, Seller consents to receive communications from RLH via text message (SMS), email, and phone regarding their listing, buyer inquiries, account status, subscription renewal, and related services. Seller may opt out of non-essential marketing communications at any time. Opting out of transactional messages (such as buyer inquiry notifications) may affect the Seller's ability to maintain an active listing under Section 7.
9. Not a Brokerage
Roosevelt Lake Homes is a listing and marketing platform, not a licensed real estate brokerage. RLH does not represent the Seller or any buyer in any transaction. RLH does not negotiate terms, prepare legal documents (other than templates), facilitate closings, or provide real estate advice. All transactions are conducted directly between the buyer and seller. Seller is encouraged to consult with a licensed real estate attorney or professional for legal and transactional guidance.
10. No Guarantee of Sale
RLH does not guarantee that the listed property will sell, nor does RLH guarantee any particular number of buyer inquiries or offers. Listing on the Site is a marketing service.
11. Content License
Seller grants RLH a perpetual, royalty-free, non-exclusive license to use all content submitted for the listing — including photos, property descriptions, and related materials — for marketing, display, and promotional purposes related to the Site and its services. This license survives the removal or expiration of the listing.
Upon request after cancellation, RLH will make reasonable efforts to remove Seller's photos and listing content from active marketing materials. However, content may be retained for archival, historical, or analytical purposes.
12. Seller Representations
Seller represents and warrants that:
Seller is the legal owner of the property (or has authority to list it for sale).
All information provided for the listing is accurate and complete to the best of Seller's knowledge.
Seller has the right to grant the content license described in Section 11.
Seller understands that all buyers must be approved by Roosevelt Lakeview Park management before a sale can be completed.
13. Indemnification
Seller agrees to indemnify, defend, and hold harmless Whip Ventures LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of Seller's listing, the accuracy of information provided by Seller, any transaction between Seller and a buyer, or Seller's violation of this Agreement.
14. Limitation of Liability
RLH and Whip Ventures LLC shall not be liable for any damages arising from the listing, including but not limited to the outcome of any buyer-seller transaction, buyer approval decisions by park management, or the accuracy of information provided by the Seller. In no event shall RLH's total liability under this Agreement exceed the amount paid by Seller in subscription fees during the 12 months preceding the claim.
15. Dispute Resolution
Any dispute arising out of or relating to this Agreement shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in the State of Arizona. Each party shall bear its own costs of arbitration. Seller agrees that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
16. Governing Law
This Agreement is governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
17. Modifications to This Agreement
RLH may modify this Agreement at any time. Changes will be posted with a revised effective date. Continued use of the Site or maintenance of an active subscription after changes are posted constitutes acceptance of the updated Agreement. Material changes will be communicated to active subscribers via email or text message.
18. Agreement Confirmation
By checking the consent box and completing payment through the Roosevelt Lake Homes checkout process (powered by Stripe), Seller confirms they have read, understood, and agree to the terms of this Listing Agreement. Stripe records the consent as part of the transaction.
Roosevelt Lake Homes ("the Site") is a listing platform operated by Whip Ventures LLC ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site.
1. About Roosevelt Lake Homes
Roosevelt Lake Homes is an online listing platform for buying and selling manufactured homes within Roosevelt Lakeview Park at Roosevelt Lake, Arizona. We are not a licensed real estate brokerage. We do not represent buyers or sellers in any transaction, and we do not participate in negotiations, closings, or the transfer of property. All transactions are conducted directly between the buyer and seller.
2. Eligibility and Use of Website
You must be at least 18 years of age to use this Site or purchase any services. This Site is intended for users interested in buying or selling homes within Roosevelt Lakeview Park. You agree to provide accurate information and use the Site lawfully. You may not use the Site to post fraudulent listings, misrepresent property conditions, or harass other users.
3. Listing Services and Fees
Sellers pay a recurring subscription fee to list their home on the Site. Subscription plans, payment options, and current pricing are displayed on the pricing page. Subscriptions auto-renew at the end of each billing period unless canceled by the Seller. Cancellation terms are described in Section 8.
In addition to the subscription, sellers may purchase optional add-on services on a one-time basis. Available add-ons and pricing are displayed on the pricing page. Add-on fees are non-refundable once the service has been performed.
Buyers use the Site at no charge. Roosevelt Lake Homes does not charge commissions or closing fees.
4. Listings and Accuracy
Sellers are responsible for the accuracy of their listing information, including property details, photos, condition descriptions, and asking price. We make reasonable efforts to ensure listings are presented accurately but do not independently verify property information. We do not guarantee the completeness, accuracy, or availability of any property listed on the Site.
5. Buyer Approval Requirement
All buyers must be approved by Roosevelt Lakeview Park management before finalizing a purchase. Submitting interest through the Site does not guarantee buyer approval. Roosevelt Lake Homes has no role in the park's buyer approval process.
6. User Submissions and Content License
Any content or information you submit to the Site — including property details, inquiries, photos, or applications — may be used to facilitate services on the Site. You retain ownership of your content but grant Roosevelt Lake Homes a perpetual, royalty-free, non-exclusive license to use submitted content, including photos, for marketing, display, and promotional purposes related to the Site. This license survives the removal of your listing.
7. Payment Processing
Payments are processed through Stripe, a third-party payment processor. Roosevelt Lake Homes does not store your credit card information. By making a payment, you agree to Stripe's terms of service. Subscription management and billing history are available through the Stripe Customer Billing Portal.
8. Cancellation and Refund Policy

10. Intellectual Property
All content on the Site, including logos, text, design, and imagery (other than user-submitted content), is owned by Whip Ventures LLC and may not be reused without written permission.
11. Indemnification
You agree to indemnify, defend, and hold harmless Whip Ventures LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Site, your listing content, any transaction between you and another user, or your violation of these Terms.
12. Limitation of Liability and Service Availability
Roosevelt Lake Homes and Whip Ventures LLC are not liable for any damages resulting from the use or inability to use the Site or any services provided through it, including but not limited to property transactions, payment processing, buyer approval decisions, or interactions between buyers and sellers.
We do not guarantee uninterrupted, error-free, or secure access to the Site. The Site may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime or service interruptions.
13. Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation between the parties.
